Your access to and use of the Service and any products/services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service or engage my services.

By accessing or using the Service or engaging my services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service or use my services.

Services and Products

CxCreations primarily offers freelance full-stack web application development and related custom code solutions ("Products"). The scope of work, deliverables, and timelines for any project will be mutually agreed upon, typically in writing, before commencement.

Payments and Refunds

Payment terms for projects will be agreed upon prior to starting work. This may include upfront deposits, milestone payments, or full payment upon completion, depending on the project's nature and scope.

Refund Policy: At CxCreations, I specialize in delivering custom code and digital products tailored to your specifications. Due to the inherent nature of these digital goods, once a Product (custom code, software, or digital solution) has been delivered to you and accepted, all sales are considered final. I am unable to offer refunds for services rendered or Products where the code or digital deliverable has been provided to and/or accepted by you.

I am committed to your satisfaction and strive to ensure the final Product meets your requirements as agreed. I encourage open and clear communication throughout the project lifecycle. If you have any concerns or issues with a deliverable, please raise them promptly so I can work towards a mutually satisfactory resolution before final delivery and acceptance.

Intellectual Property

Unless otherwise agreed in writing, upon full payment for a custom project, you (the client) will own the intellectual property rights to the specific code and deliverables created for you. I may retain the right to use general knowledge, techniques, and non-proprietary elements from projects for future work and in my portfolio, provided it does not disclose your confidential information.

The CxCreations.cc website and its original content (excluding content provided by users or clients for their projects), features, and functionality are and will remain the exclusive property of CxCreations. The Service is protected by copyright, trademark, and other laws.

Limitation of Liability

In no event shall CxCreations be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service or Products; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not I have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

My maximum liability for any and all claims arising out of or relating to any project or product shall be limited to the amount paid by you for that specific project or product.

Your use of the Service and Products is at your sole risk. The Service and Products are provided on an "AS IS" and "AS AVAILABLE" basis. The Service and Products are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

CxCreations does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service or Products will meet your requirements beyond what is explicitly agreed upon for a project.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which CxCreations operates, without regard to its conflict of law provisions.

Changes

I reserve the right, at my sole discretion, to modify or replace these Terms at any time. If a revision is material, I will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at my sole discretion. By continuing to access or use my Service or engage my services after any revisions become effective, you agree to be bound by the revised terms.
